The Municipal Court in Prague dismissed the first action against Volkswagen Group companies filed by SAFE DIESEL

The former sought damages in relation to the use of diesel cars by the Czech Post.
The Court in its ruling reasoned that the plaintiff had no locus standi in the proceedings as Czech procedural rules do not permit indirect representation before court under a commission or other similar contract.


“We welcome the Court’s decision. The Court has supported the stance that we maintained in all proceedings. It is evident from the reasoning of the Municipal Court's dismissal today that the indirect representation structure, also opted for by the plaintiff in other proceedings where it advocates for a large number of consumers and other entities, is not permissible from the procedural point of view. It was also stated, however, that the Czech legal system offers consumers a broad range of other tools allowing effective ways to seek protection of their rights.”
